PLAINTIFFS AND LEVI STRAUSS & CO. AGREE TO SETTLE CLASS ACTION SUIT OVER 2007 FLIGHT PROMOTION

Los Angeles, CA - U.S. District Court Judge Christina Snyder entered an order on Monday, May 23, preliminarily approving the settlement of a class action lawsuit brought by certain consumers who participated in the Round Trip Flight Voucher Promotion 2007.  Under the Promotion, consumers who purchased $125 or more of Dockers-branded clothing around Fathers Day weekend in 2007 were eligible to receive a free round trip airline ticket.  The named plaintiffs in the class action lawsuit, Marc and Ann Germain and Raymond P. Caccioli, alleged that they, along with many others, did not receive a round trip flight even though they qualified. 

Levi Strauss & Co. has denied wrongdoing, but acknowledged that its outside promotion administrator was not up to the task of handling the Promotion.  Although thousands of qualified consumers did receive the promotion’s benefits, due to problems in the management of the promotion thousands of others did not. 

The Plaintiffs in the lawsuit are represented by Los Angeles law firm Rosman & Germain LLP and Minneapolis law firm Zimmerman Reed, PLLP.  Levi Strauss & Co. was represented by Orrick, Herrington & Sutcliffe LLP.

Lawyers for the class say that, after investigating the facts, the proposed settlement is an excellent result.  Thousands of consumers who made qualifying purchases and returned all the paperwork asked for will be eligible to receive a $150 check and $100 in free Dockers® merchandise.  People who made qualifying purchases but did not return a form requesting flight dates and destinations will be eligible to receive $75 in free Dockers® merchandise.  And participants who received partial benefits will also be eligible to receive the $75 free Dockers® merchandise award.  No further purchases are required to receive the benefits of the settlement—class members need only make a claim for benefits.  Notice of the proposed settlement, and information on how to make a claim, will be mailed directly to those who are eligible to participate.  Further information may be obtained from the Settlement Administrator by calling (888) 429-0697.
