UPDATE:  This action is brought as a shareholder derivative action.  On December 15, 2009, Defendants filed a motion to dismiss the shareholders’ First Amended Derivative Complaint.  The court issued an Order on September 24, 2010 denying Defendants’ motion to dismiss and staying the action pending the court's receipt of a response from the board of directors regarding whether the board intends to seek dismissal of the suit.
