Originally adopted in 1938, the class action is a legal tool which allows individuals who have experienced a common injury to assert their claims in an affordable and efficient manner. Additionally, class actions are recognized as serving a consumer protection function by deterring businesses from using deceptive business practices or finding a haven from accountability by committing multiple "minor" violations. The class action provides unique empowerment for individuals who have been wronged yet who cannot afford to engage in lone combat with a powerful defendant and all its available resources.
