FEN-PHEN DIET DRUG LITIGATION
Tens of thousands of Americans have suffered serious injuries from taking the diet drugs dexfenfluramineTM ("Redux") or fenfluramineTM ("Pondimin"), often prescribed in combination with phentermine, in the popular "Fen-Phen™" diet. These injuries include heart valve damage and potentially fatal primary pulmonary hypertension (PPH). There is strong evidence that some of the companies involved in marketing and selling dexfenfluramine and fenfluramine knew that these drugs were causing serious, even fatal injuries, and deliberately concealed that knowledge from the Food and Drug Administration (FDA) to protect their profits. Many have died and thousands of others have been injured. Some individuals continue to be unaware of their injury because they have not had the medical testing required to diagnose these injuries.
Zimmerman Reed represents hundreds of injured diet drug users around the United States and has obtained meaningful recovery for these men and women. The Seventh Amendment is awaiting Final Judicial Approval, but in the mean time, claims are undergoing medical review. Once Final Judicial Approval is given, claims that have passed the medical review process will be paid. Due to a motion filed with the Supreme Court by another party, which is not expected to be considered until the fall of 2006, we do not expect Final Judicial Approval to occur until sometime in 2007.
