MINNEAPOLIS — September 25, 2026 — Zimmerman Reed LLP and Gustafson Gluek PLLC today filed a class action complaint on behalf of consumers in the U.S. District Court for the District of Minnesota, seeking to require Target Corporation to return tariff surcharges to the consumers who paid them.
The complaint alleges that Target recovered its 2025 tariff costs twice: once from consumers, through price increases, and once from the federal government, through a $994 million tariff refund Target announced in August.
The tariffs were imposed in 2025 under the International Emergency Economic Powers Act. On February 20, 2026, the U.S. Supreme Court held in Learning Resources, Inc. v. Trump that those tariffs were unlawful, and U.S. Customs and Border Protection began refunding the duties to the importers that paid them.
According to the complaint, Target raised retail prices to offset the tariffs and has not said it will return those amounts to consumers, even after receiving the $994 million refund. The complaint notes that other companies, including FedEx and UPS, have committed to returning tariff refunds to the people who paid those charges.
The named plaintiffs, two California consumers, allege they paid higher prices on everyday purchases at Target, including groceries, baby wipes, and children’s clothing.
“The tariffs were refunded,” said June Hoidal, managing partner of Zimmerman Reed. “The prices consumers paid to cover them were not. That money belongs with the people who paid it.”
The complaint, Lising et al. v. Target Corporation, Case No. 26-cv-04142, is brought on behalf of a proposed nationwide class of consumers who purchased products with a tariff surcharge from Target beginning February 1, 2025, and a California subclass. It asserts claims for money had and received, unjust enrichment, declaratory relief, and violation of California’s Unfair Competition Law.
